Waiver of Liability (Minor) and Indemnity Agreement

As the parent or legal guardian of  minor child (“Minor”), by the use of the facilities and premises of Feemster Farms, LLC d/b/a Feemster’s Corn Maze and/or Shirley Feemster, VAP Trust (hereinafter collectively referred to as “Feemster Farms”) by said Minor, and said Minor participating in activities of and on the Feemster Farms and Brady Spain, d/b/a Circle S Mobile Safari (“Circle S”), including but not limited to the mazes, pumpkin patch, and any other games, activities, entertainment or events, and the execution of this Waiver of Liability and Indemnity Agreement (“Agreement”), I expressly agree that Feemster Farms and Circle S shall not be liable for any damages arising from personal injuries or death or property damages sustained by Minor in, on or about the premises or as a result of using the facilities and the equipment therein or participating in the activities on the premises. I assume full responsibility for any such injuries or damages that may occur to Minor in, on or about the premises or arising out of the use of facilities on the premises or the activities on the premises and further agree that Feemster Farms and Circle S shall not be liable for any loss or theft of personal property of Minor. 

 I specifically agree that Feemster Farms and Circle S shall not be responsible for and do forever release and discharge Feemster Farms, Circle S and all those liable by, through, under or on their behalf, for such injuries, death, damages, loss or theft to said Minor even if the cause of damages or injuries are alleged to be the fault or caused by the negligence of the Feemster Farm or Circle S, whether such negligence is present at the signing of this Agreement or takes place in the future. This waiver does not, however, apply to gross negligence or intentional torts by Feemster Farms or Circle S.   

I further covenant and agree to indemnify and save harmless Feemster Farms, Circle S and its agents, servants, officers, insurers, directors, employees, predecessors and successors in interest, personal representatives, parents, subsidiaries, affiliates, divisions, principals, transferees, partners, executors, administrators, representatives, beneficiaries, or related companies heirs and assigns, and all other firms, corporations and persons liable on Farm’s behalf, from all liabilities, charges, expenses (including attorney fees) and costs on account of or by reason of any such injuries, liabilities, claims, suits or losses to said Minor, however occurring, or damages growing out of same, even if the cause or damages or injuries are alleged to be the fault or caused by the negligence or carelessness of the Feemster Farms, Circle S and their agents. 

I HAVE READ THE ABOVE AND FULLY UNDERSTAND ITS PROVISIONS. I ALSO ACKNOWLEDGE THAT I HAVE READ THE FARM RULES AND MAZE RULES AND AGREE TO SUPERVISE MINOR TO ENSURE MINOR ABIDES BY SAME AS WELL AS ALL OTHER RULES POSTED ON THE FARM.

By entering premises with minor child and purchasing a minor child a pass into the corn maze facility, I do agree to the above waiver of liability as a conscience and responsible choice on my own behalf and that of  minor child; that I will do my own due diligence in the care, supervision and safety of  minor child, and hereby acknowledge that safety rules have been posted and should be followed for the well being of minor child and other patrons of Feemster’s Corn Maze.

I assume full responsibility for any such injuries or damages that may occur to me in, on or about the premises or arising out of the use of facilities on the premises or the activities on the premises and further agree that Farm shall not be liable for any loss or theft of personal property.
